Law Offices of Howard G. Smith announces that a class action lawsuit has been filed in the United States District Court for the District of Arizona on behalf of all persons or entities who purchased the securities of First Solar Inc. between April 30, 2008 and February 28, 2012, inclusive (the “Class Period”), seeking to pursue remedies under the Securities Exchange Act of 1934.
First Solar engages in the design, manufacture and sale of thin-film semiconductor solar modules and photovoltaic solar power systems in the United States and internationally. The Complaint alleges that defendants issued false and misleading statements and/or failed to disclose material adverse facts about the Company's business, operations and prospects. Specifically, Defendants misrepresented or failed to disclose: (1) the full impact of certain solar module manufacturing flaws on the Company’s earnings; (2) that the Company was improperly recognizing revenue concerning certain products in its systems business; (3) that the Company lacked adequate internal and financial controls; and (4), as a result of the foregoing, that the Company's statements were materially false and misleading at all relevant times.
No class has yet been certified in the above action. Until a class is certified, you are not represented by counsel unless you retain one. If you purchased First Solar securities between March 31, 2011 and February 6, 2012, you have certain rights, and have until May 14, 2012 to move for lead plaintiff status. US appeals court backs graphic cigarette labels

A federal appeals court has upheld a law requiring new, bigger graphic warning labels on cigarette packs. The lawsuit was filed in Kentucky. It's one of two suits by tobacco companies against the federal rules that would make them slap large images on cigarette packs depicting the health ravages of smoking. The other case has so far resulted in a federal judge in Washington blocking the new requirement, arguing last month it violated free speech. That decision is being appealed by the government. But on Monday, an appeals court in Ohio ruled 2-1 to uphold parts of the Family Smoking Prevention and Tobacco Control Act, which also restricts how tobacco products may be marketed. A lawyer for N.C.-based R.J. Reynolds Tobacco Company did not immediately return a request for comment. |

High court rejects Christian campus groups' appeal

The Supreme Court has turned down an appeal from Christian groups that challenged a discrimination policy at California state universities.
The justices on Monday are leaving in place a federal appeals court ruling that found that the policy doesn't violate the Constitution. The policy says officially recognized campus groups can't discriminate based on religion or sexual orientation.
A Christian fraternity and a sorority at San Diego State University sued in 2005, arguing that the policy violates their religious freedom. The groups are restricted to Christian members. |

High court turns down Louisiana bid on Census

The Supreme Court has turned down Louisiana's bid to recover the congressional seat taken from the state as a result of the 2010 Census.
The court is not commenting on its order Monday preventing the state from pursuing a lawsuit that claims the Census unfairly included undocumented immigrants in each state's population count.
Louisiana said California, Florida, Texas and other states with large populations of undocumented immigrants gained seats in the House of Representatives at the expense of Louisiana and a handful of other states. Louisiana went from 7 to 6 seats in the House based on the Census.
The lawsuit asked the court to order the federal government to re-calculate House seats based only on legal residents. |

South Dakota's top court hears Costner art appeal

A lawyer for actor Kevin Costner has asked the South Dakota Supreme Court to affirm a ruling that he did not breach a contract with an artist whom he commissioned to produce a bronze sculpture of bison and American Indians. The Hollywood superstar paid Peggy Detmers $300,000 to make the sculpture in the 1990s for a resort he planned in South Dakota's Black Hills. The resort was never built and he instead placed the sculpture at his Tatanka attraction near Deadwood. A lower court judge ruled last summer that this alternative placement did not constitute a breach of contract. Costner's lawyer, Kyle Wiese, on Monday asked the Supreme Court justices to affirm that decision. Costner filmed much of his Academy-Award-winning movie "Dances with Wolves" in South Dakota. |

Chinese man gets 13 years for palace art theft

A Beijing court sentenced a Chinese farmer to 13 years in jail on Monday for stealing art pieces from the Forbidden City, the heavily guarded former imperial palace in China's capital. The official Xinhua News Agency said Shi Baikui, 27, was also fined $2,100 for taking the nine items made of gold and jewels in May 2011. It said six were recovered but three pieces worth an estimated $23,800 remain missing. The stolen pieces were small Western-style gold purses and mirrored compacts covered with jewels. Xinhua said Shi told the court the theft was a "spur-of-the-moment" act. The incident sparked public concern about security loopholes in the Forbidden City, also known as the Palace Museum. Xinhua said officials began a four-year security upgrade in 2009 to equip the museum with advanced security equipment and technology. |

Smith announces that a class action lawsuit has been filed in the United States District Court, Southern District of New York, on behalf of purchasers of the common stock of Nevsun Resources Ltd. between March 31, 2011 and February 6, 2012, inclusive, seeking to pursue remedies under the Securities Exchange Act of 1934.
Nevsun mines and explores for gold and base metals, such as copper and zinc. The Complaint alleges that defendants misrepresented or failed to disclose that: (a) Nevsun’s mining activities at the Bisha mine in Eritrea, Africa, produced a material amount of waste rock, rather than gold ore; (b) gold and gold ore from Bisha were materially less than estimated, and defendants knew or had reason to know this, based on data routinely collected from the mine; (c) Nevsun was progressing through the ore body at Bisha more quickly than planned, to maintain production at a rate that would not reveal to investors that the amount of gold was materially less than the Company’s estimate; (d) the Company was aware its resource model was materially defective because actual amounts of gold mined at Bisha did not reconcile with the Company’s previously disseminated estimate; and (e) Nevsun materially overstated its gold reserves at the Bisha mine.
